Sample Sales & Rescue Contracts

There is a great deal to consider before you finally decide that you wish to share your life with a wolfdog. Whether you buy a puppy, or adopt a Rescue, it behooves us to make sure there is a contract involved. In these times, it is best for all concerned that all legalities are addressed and agreed upon before any animal is transferred from one place to another. Wolfdogs are sensitive creatures, and it is best for all concerned that they have every opportunity to remain with their Owners for as long as they live.

In that light, this page includes two excellent sample sales contracts, one sample rescue contract, a sample of a Fosterage Contract and a sample Home Check form. At the end of the page are a couple of links to other pages of information you may find helpful; some "red flags" you may need to be aware of to avoid unscrupulous or uneducated breeders, and some links for more information.

Now I realize that some of the Contracts and forms may seem intrusive. We never had to worry about things the way we need to worry about them now. But that was then, and this is now, and today's world is a different one. These Contracts were designed to protect the animals, first and foremost. They have been designed to provide the best possible chance for a happy, nourishing life for the animals, and for their people. SAMPLE 1 : Puppy Sales Contracts


This contract must be signed and returned to the Breeder before the person(s) will be seriously considered as a potential Buyer. This contract is null and void if the Buyer never takes possession of any animal from the Breeder or if the Buyer at any time is no longer in possession of the animal. The Buyer agrees that failure to comply with the terms of this agreement is sufficient case for repossession of the animal(s) and that any breech of contract is punishable under the laws of the State of <Breeder’s State>. Any and all costs, legal and otherwise, incurred by the Breeder in the enforcement of this contract, including, but not limited to repossession, shall become the responsibility of the Buyer. 

The purpose of this contract is not to scare you, but to inform you of the responsibility and the dedication that will be required of you as an owner of a wolfdog. These are not animals that can be tied outside and fed once a day; these are animals that require your time, patience, companionship and understanding. When you give them this, you will have a devoted friend and companion for life. We believe that the purchase of any animal (and most especially a canid) must be a strong commitment on your behalf. You will receive a socialized puppy ready for you to mold into your own pet. The manner in which you raise your puppy will then determine what kind of adult companion you will own. This is your responsibility; it will take a lot of human interaction, patience, and time. But it's worth it; if done correctly, you will end up with a very loyal, affectionate companion. 

We will do our best to guide you in choosing the best puppy for you and to point you in the proper direction while raising/training your puppy. We will provide you with a handout detailing some of the training techniques we have used thus far in training your puppy. You should continue this training, and additional training, as it is required. If you have any questions about the training or well-being of your pet (as a pup or an adult) or if something arises that we have not addressed on the handout, please feel free to contact us. We will always be available to counsel you in what we have found works best for us. 

When you purchase one of our puppies it is for its entire life. Raised properly, it will bond and be compatible with its owners, immediate family and people it is raised with. After this bonding has occurred, it will/may have great difficulty accepting or trusting NEW owners. So if you cannot make a lifetime commitment to this unique and special animal, please do not bring one into your life. 

1. The buyer agrees to care humanely for the animal for the duration of its life. Should something arise that prohibits the buyer from caring for the animal, she/he will contact the breeder immediately and make arrangements to bring the animal back to the breeder.

2. The Buyer accepts full responsibility and liability for any and all future actions of this animal. The Buyer hereby relinquishes and waives all rights to hold the Breeder in any way responsible for any action of this animal, whatever the reason. The Buyer assumes full and total responsibility for, and agrees to fully compensate any injury and/or damage to property, people or other animals caused by the animal being purchased. This is applicable both on and off the Buyer's private property. 

3. We recommend that this animal never be left unsupervised, especially with people it is unfamiliar with. It is our further recommendation that it never be left alone with children under 12 years of age, no matter how familiar the animal is with the child. Lastly, unsupervised contact with other animals, especially unfamiliar ones is discouraged. Any injuries as a result of poor/lack of supervision are in no way the fault of the Breeder, and the Buyer hereby agrees to accept full responsibility for the animal and all its actions. (Note: our recommendations are not limited solely to wolfdogs, but to ALL large canines and reflects the recommendations of the AVMA, the HSUS, the CDC, etc., regarding large canines and children.) 

4. Firm but kind treatment will be provided for this animal at every stage of its development. We highly recommend that early in puppyhood, the puppy be taken to and trained in a beginner obedience class with a qualified trainer for both training and socialization purposes. If practical, for the particular  animal, further training is encouraged. All treatment and training of this animal will be done in a humane manner, using positive reinforcement. The training of the animals directly affects the behavior, temperament and actions of the animal. At no time will the Buyer abuse or mistreat the animal. Abuse and/or mistreatment are determined by the guidelines of the American Society for Prevention of Cruelty to Animals (ASPCA). Abused and/or mistreated animals will be confiscated by the Breeder with no retribution! 

5. The animals will be kept current on all medical vaccines, including rabies, and wormings. The same medical treatment for dogs applies to wolfdogs.  

6. The animal must have a minimum of two hours of human companionship each day. A possible exception would be one hour of human companionship if the animal has another full-time canine companion. Both forms of companionship are preferred. However, we recommend longer and more extensive human contact as you want to socialize this animal to its human pack. These are highly social animals and do better if they are integrated into the family and introduced to a variety of people. 

7. This animal will NEVER be tied/chained except in emergency/temporary situations. In such situations, the chain must stop the animal 2' before any fencing so that the animal does not jump the fence and accidentally hang himself. All obstacles that can cause this potential hazard will be removed from the chained area. Chaining the animal as a primary means of containment will null and void the contract and be grounds for the Breeder to confiscate the animal.

8. Nutritious food will be fed sufficiently on a daily basis. A good kibble should have the following ingredients: protein (adults 24-30%; pups 30%), fat (adults 18-20%; pups (21%), fiber (both 3-3.5%), and moisture (both 10-11% or lower). I've found that the best diet for these animals is a combination of raw bones, meats, veggies, along with the kibble. 

9. The water supply should be fresh (daily) and unlimited at all times. We have found that a small, heavy duty pool or water trough for the animal to play or cool off in has been beneficial for them. 

10. The Buyer will provide a secure and comfortable (minimum of 25' X 50') area, pen or yard. A smaller kennel (minimum of 100 square feet per animal) is acceptable for holding the animal occasionally--but ONLY for temporary confinement. If the animal is placed in a kennel as the primary means of containment, it will null and void the contract and be grounds for the Breeder to confiscate the animal.

11. The Breeder will not disclose the pedigree of the puppies to the Buyer if the animal is purchased at the pet quality cost of $XXX with the spay/neuter contract. The Breeder will disclose type of wolf and heritage to these buyers, but documented pedigrees will not accompany these animals. The Breeder will disclose the complete pedigree information (with separate legal contracts and stipulations) to those wishing to pay the full $XXX breeding quality amount and to register the pups as breeders. Any subsequent changes or clarification in the pedigree will be notified in writing to the Buyer by the Breeder. The Buyer waives his/her right to hold the Breeder responsible for subsequent changes to the lineage that might affect the animal's percentage or pedigree. 


11. After the purchase of the animal, the Buyer agrees to maintain contact with the Breeder for the lifetime of the animal. If at any time during the animal's life, the owner must relinquish ownership for any reason, the Breeder must first be contacted. If the animal is returned to the Breeder, the Buyer relinquishes any and all rights to the animal, and the Breeder is under no obligation to refund any or all of the purchase price. The Breeder reserves the right to resell or make subsequent necessary decision(s) as to the well-being of the animal. If the animal goes into rescue, the Buyer relinquishes to the Breeder his purchase price and all rights to the animal or to a resale price, if there is one.  If the animal is going to an individual of the Buyer’s choice, the Breeder has the right to inspect or request photos of the new environment and the animal's health and condition at any reasonable agreed upon time. The Breeder reserves the right to interview the new owner, and if there is sufficient, legitimate reason, can veto the new Owner. If there is a new Owner, he/she will be required to sign a new contract with the Breeder. If ownership is transferred without the consent of the Breeder, the registration of the animal will become null and void, if a pedigree has been provided by the Breeder. Any costs incurred in, but not limited to, the Breeder regaining custody and transportation of the animal shall be the sole responsibility of the Buyer. 

12. Any breeding of the animal must be done for the improvement of the breed and with the full knowledge of the Breeder. Breed Standards must be kept in mind. (Prior to breeding, hip X-rays should be taken and OFA certification received.) The owner agrees to breed only to accurately  portrayed animals. The owner is also required to accurately record the ancestry of any resulting puppies; failure to comply will result in the animal(s) and/or resulting litter(s) being registered as limited/pet status animals AND to prosecution to the fullest extent under the law. The Buyer hereby assumes all responsibility for veterinary costs incurred by any pregnancy, authorized or not. The Buyer assumes full responsibility for care and placement of any litters parented by the animal. In no  way can the Breeder be held liable for the reproductive actions of the animal, including, but not limited to, veterinary expenses. 

13. If, during the first 72 hours following the buyer’s purchase of the puppy, it is found to be in unsatisfactory health for reasons not attributable to the Buyer, the Breeder must be notified and the animal may be returned to the Breeder with appropriate documentation from the Buyer's licensed veterinarian, and a refund or replacement (if possible and if the Buyer requests) will be granted by the Breeder. 

14. The Breeder provides an 26-month warranty against any congenital health problems in the animal, including, but not limited to, hip dysplasia. If possible, the Breeder will retrieve the animal and replace with another if the Buyer chooses, or the Breeder will reimburse medical expenses up to the initial cost of the animal. This warranty is on condition that the animal be taken to a licensed veterinarian no later than 2 weeks after purchase (for any puppy illnesses) and again between 24 and 26 months of age for OFA and the results of the examination (e.g., copy of X-ray, bill, and findings) be sent to the Breeder. Any other congenital health problems arising at a later date must be verified by two licensed veterinarians and the results MUST be sent to the Breeder. Any and all health problems incurred that are not the result of a congenital defect are the responsibility of the Buyer. 

The Breeder does not intend to imply any faults in the animal or its temperament by the waivers in this Contract, but intends to warn the Buyer of the responsibilities inherent in owning a large canine of any breed. 

This contract is NOT transferable and its terms are NON-negotiable. Breech of Contract will nullify this contract and result in forfeiture of animal with no recourse.

SAMPLE 2 : Puppy Sales Contracts

CONTRACT OF SALE

These conditions and requirements must be agreed to as part of the CONTRACT OF SALE signed by the Buyer (s) and Seller for the purchase of a wolf hybrid or other animal from (Name) KENNELS.

l. Buyer will provide a secure and comfortable pen or yard area, MINIMUM size of 25’X25’, with no more than two animals being kept in this size area at any one time. Fencing must be strong and secure enough to prevent escape. Fencing will be minimum of 6’ in height. If this height is not sufficient to prevent the animal(s) from escaping, the fencing will be hot-wired, and overhang, roof or more height will be added. (This is strongly advised as soon as the fencing is erected so the animal never learns to escape.) Secure ground wire will be attached on the inside around the bottom of the fence or the pen will be floored in some other way to prevent digging out.

2. The animal will not be restrained on a chain or tie-out except in an emergency or VERY temporary basis.

3. The animal will have either companionship from humans for at least two hours on a daily basis or will have a compatible canine companion at all times. (Both are preferable.)

4. A shaded area and good shelter dry within under normal weather conditions, and large enough to adequately house all animals will be provided within the pen area.

5. Nutritious food will be provided in sufficient quantities for the size and age of the animal daily. Fresh water will be available at all times. All medical vaccinations will be kept current and any other veterinary care provided that is deemed necessary to keep the animal in good health.

6. The pen area will be cleaned of droppings on a daily basis. Any debris that may be injurious to the animal will be removed immediately.

7. All pups must be spayed or neutered by the age of one year. This requirement is waived if the Seller and Buyer agree to the following terms and sign the waiver.

A. A female pup must not be bred until she is at least twenty months of age.

B. The buyer agrees to accurately represent the percentage of wolf of both the animal purchased and the offspring produced from this animal to the best of his/her knowledge.

C. The Buyer agrees to breed the pup to non-aggressive dog breeds or wolf hybrids of proven background and percentage. By signing, Buyer agrees to the above conditions in part 7.

D. The Seller reserves the right to examine and approve any mate that is to be bred with this animal prior to time of breeding. The Buyer may not breed this animal without the written consent of Seller.

8. If a waiver is not granted, Seller must receive a certification from a veterinarian by the age of one year that the pup has been spayed or neutered or all registries will be notified not to accept any animals produced by this pup. Failure to comply with this agreement will void this contract and gives the Seller the right to repossess the pup.

9. The Seller maintains the right to inspect the animal at his new (Buyer’s) home. The Seller or his designated agent may do this.

10. If the animal has to be given up for ANY reason, the Seller must be notified first. The Seller has first "Right of Refusal" to the pup. If another home is to be considered, the Seller must agree to the choice of home before the animal can be placed.

11. A firm but kind training will be provided for the pup at every stage of it’s development. Training of all canines is encouraged. However, an understanding of the animal and its limitations and trainability must be understood. The animal will not be placed with someone else for training. The animal and Buyer will work together in all training efforts.

12. Direct supervision by an adult will be provided during any and all contact between children and the animal. (This is an important rule to follow when dealing with any dog as the animal may accidentally harm the child with rough play or may miss-read the child’s actions as threatening.)

13. The animal being purchased is guaranteed to be free of major congenital defects such as hip dysplasia or chondroyplasia. Should any serious congenital defect appear as the animal matures, the Buyer must provide accurate documentation from a licensed veterinarian of such to the Seller and claims of such must be made in writing within two years from date of purchase. Replacement of defective animal will be made on agreement of both parties. An animal for which a replacement is made may be euthanized, returned to Seller or left with the Buyer. The Seller and the Buyer will make the decision. If the Buyer wishes to keep the animal for which a replacement is made, the Seller will require the original animal to be spayed or neutered and proof of same provided to the Seller before replacement is made.

14. It is hereby understood and agreed by the undersigned that he/she, in consideration of (Name) KENNELS, their agents or employees, selling said animal (s) to the undersigned Buyer (s), he/she does hereby release, acquit and forever discharge (Name) KENNELS, their agents or employees of, and from any and all actions, causes of action, claims, demands, damages costs, loss of services, expenses and compensation, on account of, or in any way growing out of, any and all known or unknown bodily injuries and property damages resulting, or to result from the ownership of the animal (s) purchased from (Name) KENNELS, their agents or employees, at any time, now or hereafter; and further agrees that they will defend and guarantee any damages assessed the said (Name KENNELS, their agents or employees resulting from the violation of this agreement on the part of the undersigned Buyer (s).

15. This contract of sale and release of liability contains the entire agreement between the parties hereto, and the terms of this agreement are contractual and not a mere recital.

16. I/We further state that I/we have carefully read the foregoing and know the contents thereof and I/we sign this CONTRACT OF SALE of my/our own free will.

o      How do the animals react to the owner's response?



Important Question to Answer:

o      Explain that re-homing a dog is stressful for the dog.

 

o      That often the new puppy may have training accidents, and that new pups can be destructive when left unattended.

Additional Suggestions To The Home Evaluator:

·         If you need to take notes during the visit, please do so discreetly on a small note pad, rather than on this form. It is preferred to have the applicants feel at ease with you and to be themselves. Complete this form after the visit is over, when you are not in the presence of the applicants.

 

·         Qualities to note are sincerity, commitment, tolerance of normal animal behavior, honest representation of the home environment, children's behavior with other pets, and expected role of the children in pet care. Obtain explanations about the absence of any family members during the visit. Feel free to ask leading questions to begin productive conversation. Often good conversation will reveal far more than questions.

 

·         Do not make any promises to the applicants or indicate whether or not they will be approved. Please refrain from discussing any particular animal or breeder.

General Foster Care Agreement

IT IS AGREED:  

   1.The foster individual(s) acknowledge(s) the purposes and aims of the Rescue Program and recognizes the reasonable interest in assuring the proper and humane treatment of rescue Wolfdog during temporary placement with the foster home. The foster individual(s) represent(s) that no member of the family has been charged with cruelty to animals and agree(s) to accept the following conditions and restrictions in order to be eligible to provide a foster home for rescued Wolfdogs.

      

   2.The foster home will keep the rescue Wolfdog indoors or in a kennel run. It will not be tied to a doghouse or to a chain.

      

   3.The foster home will provide the rescue Wolfdog with an adequately fenced yard and/or will walk the dog on a leash daily. At no time will any Wolfdogs be allowed to run loose while unattended.

      

   4.The foster individual(s), when away from home for over a 24 hour period, will advise the rescue coordinator, so that alternative arrangements can be made for the Wolfdog.

      

   5.The foster home acknowledges that their residence, if rented, permits pets pursuant to the lease, or by special permission of the landlord or resident manager.

       

   6.The rescue Wolfdog will never be attack- or guard-trained or used as a property guard dog.  Further, this dog will not be used in any aspect of dog/animal fighting.

      

   7.The foster family will provide said rescue Wolfdog with all the care and attention necessary to ensure its health and well being. This will include providing sufficient food, water, exercise, competent veterinary care, annual vaccinations, deworming, prompt veterinary care in the event of illness or injury and heartworm preventative. The foster home will give the rescue coordinator receipts for all medical expenses and will maintain the expense log for any rescue dogs in their care.

      

   8.The rescue Wolfdogs will not be abused in any manner. The rescue Wolfdog will not be beaten or otherwise treated cruelly, and will not be the subject of, or subjected to, any biological, chemical, psychological, or other experiment. 

    

   9.In the event the rescue Wolfdog is lost or stolen, the foster individual(s) will contact the rescue coordinator immediately, advertise in major newspapers and make all reasonable attempts to locate the animal.

      

  10.The foster individual(s) shall not give, lease, or otherwise transfer custody of the rescue Wolfdogs to any other person, or to any business or organization, except to return the dog to the Rescue Program.

      

  11.The foster individual(s) will promptly notify the rescue coordinator of all and any changes in residence,  mailing address, and/or telephone number.

      

  12.The foster individual(s) will notify the rescue coordinator immediately of the rescue Wolfdog's death and/or serious illness.

      

  13.The foster individual(s) must notify the rescue coordinator within 12 hours of any bite by the Wolfdog inflicted on a human or another animal not owned by the foster individual(s).

      

  14.The foster individual(s) recognize(s) the need to ensure that the rescue Wolfdog is receiving proper and humane care, and agrees to allow inspection of the foster home and the conditions in which the rescue Wolfdog is living, at any reasonable time by a representative of the Rescue Program.

      

  15.The foster individual(s) agree(s) to immediately surrender custody of the rescue Wolfdog to a rescue representative upon demand. The foster individual(s) agree(s) that the foster individual(s) has/have no legal ownership and will not obtain any legal rights to the rescue Wolfdogs in their care.

      

  16.Should it be necessary to litigate in connection with any dispute concerning the care, treatment, and-or custody of a rescue animal directly under the care of the foster home, the foster individual(s) agree(s) to pay all court costs and reasonable attorney fees.

      

  17.The foster individual(s) recognize(s) that although the Rescue Program has made reasonable efforts to provide a rescue Wolfdog which is compatible with the foster individual's environment,the foster home agrees that the Rescue Program does not warrant the temperament or behavior of the rescue Wolfdog and that the Rescue Program is not to be held liable for any acts of the rescue Wolfdog while living with the foster individual(s). The foster family agrees to notify the rescue coordinator immediately if they believe the temperament or behavior of the rescue Wolfdog is incompatible with  the foster home environment.

      

  18.The foster individual(s) state(s) that they have reasonable knowledge about the proper care of dogs and more specifically, Wolfdogs. The foster home agrees to be responsible for the proper supervision of the rescue dog in their possession. Should the Rescue Program suffer any damages or legal costs as a result of the negligent supervision of the rescue dog in the foster home's care, the foster individual(s) agree(s) to indemnify the Rescue Program for all such damages and costs.

      

  19.The foster individual(s) acknowledge(s) that the purpose of the Rescue Program in establishing the conditions in this agreement is to safeguard the health and well-being of the rescue Wolfdog, to protect the rescue Wolfdog against neglect, abuse and cruelty and to temporarily house a rescue Wolfdog until a permanent home is found. The foster individual(s) enter(s) into this Agreement  freely and with knowledge.
